Baby 150x150 Court Orders Sperm Donor To Pay Child SupportIt’s been said that no good deed goes unpunished, and that would certainly seem true for a Kansas man who responded to a Craigslist ad from a lesbian couple seeking a sperm donation.

Although the couple absolved the donor, William Marotta, from financial support for the resulting child, the state of Kansas did not. Last month, a Kansas court ordered Marotta to pay support for the three-year-old daughter he fathered.

The couple, Angela Bauer and Jennifer Scheiner, signed a contract that excluded Marotta from any future financial responsibility for their daughter. Bauer and Scheiner split up in 2010, and Scheiner filed to receive welfare benefits for the girl after Bauer had to quit work for health reasons.

The Kansas Department of Children and Families refused the request for benefits, and demanded to know the identity of the father so he could pay child support. The agency also voided the contract signed by the couple and Marotta since a licensed doctor did not handle the insemination, which is a prerequisite for a valid contract under Kansas law.

Marotta is challenging the ruling in court today, arguing that the decision sets a bad precedent. Both Bauer and Scheiner support Marotta’s motion to dismiss.
